Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kaya Core, Inc., a Delaware C Corporation (EIN: 30-1478833), operating Boekhoud Buddies at boekhoudbuddies.com ("Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Boekhoud Buddies is invoicing and bookkeeping software from Kaya Core, Inc. for migrant ZZP in the Netherlands (UI in NL, EN, RO, TR, RU). It is not a boekhoudkantoor, accounting firm, or tax-advisory practice. The Service includes:

  • Invoice creation, sending, and management
  • Expense tracking and categorization
  • VAT (BTW) calculation and reporting assistance
  • Bank account integration via PSD2-compliant providers
  • Financial reporting and dashboard analytics
  • Client management

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription & Payments

4.1 Free Trial

We offer a 14-day free trial. No credit card is required to start. At the end of the trial, your account will be limited until you subscribe to a paid plan.

4.2 Billing

Paid subscriptions are billed monthly through Stripe. Prices are displayed in euros (€) and are exclusive of applicable VAT (BTW). We reserve the right to change prices with 30 days' notice.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. User Responsibilities

You agree to:

  • Provide accurate financial data and business information
  • Use the Service in compliance with Dutch and applicable laws
  • Not use the Service for fraudulent, illegal, or unauthorized purposes
  • Not attempt to reverse-engineer, copy, or distribute the Service
  • Maintain accurate records for your own tax obligations

6. Data Ownership

You retain full ownership of all data you input into the Service, including invoices, client information, and financial records. We claim no ownership rights over your content.

You grant us a limited license to process your data solely for the purpose of providing and improving the Service.

7. Disclaimer

Important: Boekhoud Buddies is a bookkeeping tool, not an accounting firm or tax advisory service. The Service does not constitute financial, legal, or tax advice. You are responsible for verifying the accuracy of your financial records and meeting your tax obligations. We strongly recommend consulting a qualified accountant or tax professional.

8. Limitation of Liability

To the maximum extent permitted by law, Kaya Core, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience unforeseen outages. We will make reasonable efforts to notify you of planned downtime.

10. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, you may export your data for up to 30 days. After that period, your data will be permanently deleted, except where retention is required by law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. For disputes involving EU consumers, mandatory consumer protection laws of your country of residence may apply.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service at least 30 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
